Terms of Service
1. Services
We provide chimney cleaning, inspections, and related maintenance. Scheduling is subject to technician availability and weather conditions.
- Standard services include: chimney sweeping, level I/II inspections, draft troubleshooting, cap and damper checks.
- Optional services may include minor masonry/tuckpoint touch-ups, bird nest removal, and creosote-level remediation where safe and permissible.
- Service scope is limited to what can be performed safely without structural modifications unless expressly quoted and approved.
Service availability can be curtailed by rooftop pitch, ice, severe winds, lightning, or other hazards determined at the technician’s discretion.
2. Pricing
Prices shown are in CAD and exclude taxes. Final amounts may vary by province and site complexity.
- Quoted rates assume safe access and standard creosote accumulation; heavy buildup or obstructions may incur additional time and charges.
- Travel surcharges may apply to remote locations or where ferry/permit access is required.
- Written estimates are valid for 14 days unless otherwise specified.
Promotional pricing cannot be combined with other discounts unless explicitly stated in writing.
3. Liability
We use industry-standard practices but are not liable for pre-existing conditions or concealed defects.
- ClearFlue is not responsible for damages caused by hidden construction flaws, prior improper installations, or vermin/animal activity.
- Any recommendations we provide are advisory; final decisions regarding repairs remain with the property owner.
- To the maximum extent permitted by law, our aggregate liability shall not exceed the amounts paid for the specific service giving rise to the claim.
4. User Obligations
Provide safe roof access and disclose known issues. Follow post-service safety guidance.
- Ensure clear access to fireplaces, stoves, and ladders; remove fragile items from nearby work areas.
- Inform us about pets, security systems, or special building access protocols before the appointment.
- Do not use the appliance within 24 hours prior to cleaning to ensure it is safe and cool.
5. Bookings and Cancellations
Appointments may be scheduled online or by phone. You agree to provide accurate contact details and site information.
- Cancellations or rescheduling within 24 hours of appointment time may incur a short-notice fee.
- If we arrive and cannot proceed due to unsafe conditions or access restrictions, a call-out fee may apply.
6. Access and Safety
Technicians reserve the right to refuse or pause work if conditions are unsafe.
- You authorize us to use reasonable access methods provided by you (ladders, roof hatches) deemed safe by the technician.
- Snow, ice, or roof fragility may limit service scope; we may propose alternative remedies or rebooking.
7. Payments and Invoices
Payment is due upon completion unless otherwise agreed. We accept major Canadian payment methods.
- Unpaid balances may accrue interest as permitted by provincial law and may be referred to collections.
- You agree to provide accurate billing details and to settle any additional charges authorized onsite.
8. Warranties and Guarantees
We warrant that services are performed in a professional and workmanlike manner consistent with industry standards.
- No warranty is provided for conditions outside our control, including structural defects, weather damage, or misuse after service.
- Any guarantee must be stated explicitly on your invoice to be enforceable.
9. Limitations of Use
You agree not to misuse our website, booking tools, or communications channels.
- No automated scraping or data harvesting from our site without written permission.
- No submission of false requests, fraudulent chargebacks, or abusive language toward staff.
10. Appointments and Delays
Appointment windows are estimates. Traffic, prior job complexity, and weather may affect actual arrival time.
- We will notify you of material delays when reasonably possible.
- If delays make service impractical, we may rebook without penalty to either party.
11. Customer Content and Feedback
By providing feedback or photos for diagnostic purposes, you grant us a non-exclusive license to use such content to deliver and improve services.
- Do not upload or share materials that infringe third-party rights or contain sensitive personal data beyond what is necessary.
12. Third-Party Products
Where we recommend third-party products (e.g., caps, liners), warranties and support are provided by their respective manufacturers unless specified.
- We are not responsible for manufacturer defects but will assist with documentation upon request.
13. Privacy and Data
We collect and use personal information in accordance with applicable Canadian privacy laws. We limit data to what is required for booking, service delivery, and communication.
- You consent to receive service-related communications by email, SMS, or phone. You may opt out of non-essential marketing messages.
14. Intellectual Property
All ClearFlue trademarks, logos, and content are owned by ClearFlue or its licensors. No rights are granted except as necessary to use our site and services.
15. Modifications to Terms
We may update these Terms from time to time. Continued use of the site or services after changes take effect constitutes acceptance of the updated Terms.
16. Termination
We may suspend or terminate access to our site or services for violations of these Terms, unsafe conduct, non-payment, or as required by law.
17. Governing Law
These Terms are governed by the laws of the province in which service is performed and the federal laws of Canada applicable therein, without regard to conflicts of law principles.
18. Dispute Resolution
Parties agree to attempt good-faith resolution within 30 days of notice. If unresolved, disputes may be submitted to mediation or small claims court where appropriate.
19. Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions will remain in full force and effect.
